Legislation currently being introduced to the House floor seeks to destroy your ability to bring a lawsuit, or receive proper compensation for winning such a suit. The bills have been quietly introduced by politicians and corporate lobbyists who seek to quench corporate greed by increasing overall profits at the expense of the American public. Sadly, in this day and age, corporate welfare is triumphed over the welfare of the American public-the most notable example being the 2007-2008 financial crisis triggered by Big Banks' greed and fraud. Such unaccountable power of corporations goes against the intentions of the United States' founding members, and now is seeking to destroy your constitutional right to a trial by jury.
Politicians in the pockets of large corporations and insurance companies have devised a plan aimed at destroying your right to hold those in power accountable for their misdeeds. Their plan is to enact laws that will all but destroy your right to use the legal system to protect yourself. They have introduced bills which, if passed, will enact arbitrary changes to courts all across the country.
Importantly, the full scope and domino effect these bills may have is unknowable, as they have not been examined in a single hearing on the floor, and thus have not been scrutinized by lawmakers or citizens weighing the benefits and risks. The so called "Protecting Access to Care Act"
According to the Journal of the American Medical Association medical negligence is the 3rd leading cause of death in the U.S. - behind heart disease and cancer. This bill attempts to eliminate the rights of Americans to bring certain health care claims when they are injured by medical malpractice and dangerous drugs and devices, or when they or their families are injured or killed due to negligence. H.R. 1215 limits compensation for injuries caused by medical professionals, including hospitals, nursing homes, and medical device manufacturers to only $250,000.00, regardless of how much that injury devastated your life or the extent of malfeasance by the medical professional or company.
The so called "Fairness in Class Action Litigation Act"
This bill will strip Americans of the ability join with others to bring consumer, worker, or civil rights class actions against corporations. This would have prevented anyone affected by the Exxon Valdez oil spill from compensation, or anyone affected by Big Tobacco's lies about cancer and health related risks. Distribution of costs is the hallmark of a class-action lawsuit. Without the ability to bring class action suits, many individuals will be precluded from recovery by the costs alone of bringing litigation against a big corporation. Eliminating class-action law suits would essentially destroy the ability to bring the kinds of cases that keep us safe from the unyielding power of big corporations.
These bills not only trample on your individual rights, but also allow large corporations to be deceptive and trump their financial interests above your constitutional rights.
