Doctor allegedly removes kidney rather than mass

Medical malpractice errors range from the subtle to the shocking. However, the facts alleged in one recently filed claim might leave Arizona readers especially puzzled.

Specifically, a woman from Iowa filed a lawsuit naming a South Dakota doctor along with his practice as defendants. The woman alleges that the doctor performed surgery on her in 2016 to remove a mass that had developed on her adrenal gland. Instead of removing the mass, however, the doctor allegedly removed one of the woman's kidneys. She says she suffers from fatigue, pain, mental distress and depression as a result of the erroneous procedure.

The complaint claims that on Oct. 5, 2016, the doctor was told by the hospital's pathology department that he had removed the patient's kidney rather than the mass on her adrenal gland. It further claims that the doctor told the patient on Oct. 7 that he had not yet heard from the pathology department on the matter. The patient says the doctor contacted her on Oct. 11, telling her he hadn't gotten the whole mass and saying she'd have to undergo a second surgery.

According to the lawsuit, a second procedure was conducted at Rochester's Mayo Clinic. In a case where surgical errors are alleged, an attorney might be able to help the injured party by gathering evidence and conducting witness depositions to build a legal strategy. In malpractice cases, the plaintiff is often at an information disadvantage versus the defendant because health care workers have a better understanding of what happened.
